3. What data do we process from you?

4. Is there an obligation to provide the data?

The provision of your data is not required by law. However, some of the data mentioned is required in order to be able to submit an application. If an employment contract is concluded between you and a company of the DER Touristik Group, the information you enter will be forwarded to the HR department for the conclusion of the employment contract. The provision of other data is voluntary, but may be necessary for the use of certain services. This applies, for example, to data for setting up a job ticker for suitable jobs. We will inform you when entering data if the provision is required for the respective service or function. These data are marked as mandatory fields. In the case of required data, non-provision means that the service or function in question cannot be provided. In the case of optional data, non-provision may mean that we cannot provide our services in the same form and to the same extent as usual.

5. For what purposes do we process your data and what is the legal basis for this?

5.1 Implementation of application processes

You have the option of applying online for an advertised job or submitting an unsolicited application. You can use the online application system for this. Your data and the attached files are transmitted via an encrypted connection. Your data will be received by the HR department and forwarded to the specialist department responsible for the advertised job or to the persons entrusted with handling the application process. The same applies if you send us an application via email or post. Everyone involved treats your application documents with due care and confidentially.

We process your data, which you send us in connection with an application, to determine your suitability for the job (or any other open positions in the DER Touristik Group company where you are applying for a job or submitting an unsolicited application). review and complete the application process. The legal basis for the data processing described is Art. 6 Para. 1 Letter b of the General Data Protection Regulation and Section 26 Para. 1 Sentence 1 BDSG (decision on the establishment of an employment relationship).

If we conclude an employment contract with you, we will process your data for the purposes of the employment relationship if this is necessary for its implementation or termination. The legal basis for the data processing described is Art. 6 Para. 1 Letter b of the General Data Protection Regulation and Section 26 Para. 1 Sentence 1 BDSG (implementation of the employment relationship).

5.2 Defense of Legal Claims

We process your data insofar as this is necessary to defend against legal claims asserted from the application process. The legal basis for this is Art. 6 Para. 1 Letter f GDPR (balancing of interests, based on the interest of the DER Touristik Group company to which you are applying for a job or submitting an unsolicited application, in being able to defend against claims in proceedings under the General Equal Treatment Act and possibly other claims).

5.3 Use of your application for other suitable jobs (extended use) and inclusion in the candidate pool

If your application does not match the job requirement profile you are looking for, but appears suitable for other jobs, you can agree to the extended use. You can also agree that your application will remain in the candidate pool for a further 6 months in order to then be able to fill any new vacancies. to be considered.

However, this means that recruiters cannot approach you with new jobs from DER Touristik Group companies for more than 6 months at a later date that match your personal qualifications and interests. A consideration in such a new application process will only take place after your consent. You can edit, change or delete the information you have provided at any time. The legal basis for the data processing described is Art. 6 Para. 1 Letter a of the General Data Protection Regulation (consent). Your data will be deleted after three years of inactivity at the latest.

5.4. Signature of the employment contract by Docusign

If you are accepted, you will receive your employment contract from our HR partner. This can be done through the DocuSign software. For this purpose, your employment contract and the associated documents are uploaded in encrypted form and assigned to your name and email address. You will then receive the documents from the DocuSign software by email. When you open the envelope from your mailbox, you will be identified by your email address and can sign the documents. When all parties have signed, you will receive the finished document including a DocuSign certificate by email.

The legal basis for the data processing described is Art. 6 Para. 1 Letter b of the General Data Protection Regulation (Contract) and Art. 6 Para. 1 Letter f of our overriding legitimate interest in an efficient signature process.

If you have given your consent to be included in the pool of candidates, all of the DER Touristik Group companies listed below can access your data so that they can contact you if there is a suitable job. In addition, service providers who support us in fulfilling our tasks may have access to your data. These are service providers in the following categories:

7. Is data processed outside the European Union?

We transmit your data to recipients outside the scope of the EU GDPR and if there is neither an adequacy decision according to Article 45 paragraph 3 nor suitable guarantees according to Article 46, including binding internal data protection regulations, only exist if the transmission is necessary:

8. How long is the data stored?

We store your data for as long as is necessary to make a decision about your application. If an employment relationship does not come about, we can also continue to store your data insofar as this is necessary to defend against possible legal claims. As a rule, the application documents are deleted six months after notification of the rejection decision, unless longer storage is required due to legal disputes. If we conclude an employment contract with you, we transfer your data from the online application system to our personnel information system. Otherwise, we delete your data after these periods or set the deletion period according to these criteria:

  • Candidate profile data after three years of inactivity of the candidate at the latest
  • Data after revocation of consent or after 6 months at the latest
  • Data on an application six months after completion of the application process
  • Any voice recordings after three months

9. What are your rights?

You can request information about your personal data processed by us.
